Form 8 – Regulation 38 Statement —

Regulation 38 fire safety information statement. The Building Regulations 2010.

This form is used to when the Fire Safety Order (FSO) applies, (most premises other than those that are serving as a shared dwelling) to confirm a declaration that:

  • In accordance with Regulation 38 of the Building Regulations 2010 (as amended) all the information shown above is fully understood, care has been taken to prepare accurate information which has subsequently been passed onto the person responsible for fire safety to allow them to manage the building effectively.
  • We have also received a notice from the responsible person acknowledging receipt of the fire safety information and confirming the information provided is sufficient to enable them to understand, operate and maintain the building (and the fire safety systems in it) after the building work in question.
  • AD B Volume 2 2-19.3 and 19.4 provide basic detail required
  • For complex buildings see AD B Volume 2-19.5-19.6 and BS9999 Clause 9 and Appendix H as more detail is required

    Responsible Person*

      Note: *The owner, landlord or occupier of business or other non-domestic premises, will be responsible for fire safety. They are known as the ‘responsible person’.

    Declaration & Send

      I confirm that: The building work is complete and, to the best of my knowledge, complies with Building Regulations.

      I have reviewed the Regulation 38 checklist and fulfilled all my duties under the Building Regulations, including passing the fire safety information to the responsible person*.

      The responsible person has confirmed to me that the fire safety information I provided is sufficient for them to understand, operate, and maintain the building.
